These terms and conditions (the "Terms and Conditions") govern the use of www.atnourish.ca (the "Site"). This Site is owned and operated by Nourish - Offline Social Club.
By using this Site and/or purchasing a membership, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
1. Age Restrictions
The minimum age to use our Site and join the Club is 18 years old. By using this Site, users agree that they are at least 18 years old.
2. Membership & Accounts
When you create an account on our Site, you agree to the following:
- You are solely responsible for your account and the security and confidentiality of your account, including passwords or sensitive information attached to that account.
- All personal information you provide to us through your account is up-to-date, accurate, and truthful and that you will update your personal information if it changes.
- Smart Tags: Membership may require a digital access device ("Smart Tag"). These tags remain the property of Nourish and must be left on-site in the designated mailbox after each visit. If a Smart Tag is lost or damaged, a $15.00 replacement fee will be charged to the member.
3. User-Generated Content
Members may have access to an internal community feed where they can post profile pictures, videos, and comments.
Ownership: You retain ownership of the content you post.
Marketing Use: Nourish - Offline Social Club will not use your uploaded images or videos for public marketing or website promotion without your express prior written consent.
Prohibited Content: You agree not to post any content that is illegal, offensive, or violates the Code of Conduct (see Section 8).
4. Payments, Subscriptions, and Billing
Services: We offer memberships (monthly or multi-month), event tickets, workshops, and rentals.
Payment: Payments are processed via the Site. By providing payment information, you authorize our use of and access to the payment instrument you have chosen to use.
Automatic Renewal: For subscription-based memberships, your payment method will be automatically charged at the start of each new "Paid Period" (e.g., every month or every three months) until you cancel.
5. Cancellation Policy
To avoid being charged for the next billing cycle, you must cancel your membership at least 48 hours prior to your next scheduled payment date. Cancellations made less than 48 hours before the billing date may result in the final payment being processed, and no refund will be issued for that period.
6. Refund Policy (Nova Scotia Consumer Protection)
In accordance with the Nova Scotia Consumer Protection Act regarding social club memberships:
- 10-Day Cooling-Off Period: You have the right to cancel your initial membership and receive a full refund within 10 days of your initial purchase.
- General Policy: After the initial 10-day period, all membership fees, event tickets, and workshop fees are strictly non-refundable.
- Individual Tickets: Single-event tickets, one-day workshop passes, and experience tickets purchased outside of a recurring membership are considered 'time-specific entertainment services' and are exempt from the 10-day cooling-off period. Cancellations made more than 48 hours before the event start time are eligible for a full refund. Cancellations made within 48 hours of the event are non-refundable. However, you may transfer your spot to another eligible guest at any time before the event begins by emailing contact@atnourish.ca with the full legal name and email address of the person taking your place. Transferred spots are subject to Nourish's approval.
- Material Change in Circumstance: Nourish may, at its sole discretion, consider a pro-rated refund or early termination if a member provides written proof of a "Material Change," defined as:
- Relocating your primary residence more than 30km away from 3045 Robie St. (Proof required: Utility bill or lease).
- A medical necessity preventing participation (Proof required: Doctor’s note).
7. Goods & Physical Services
Refunds on Goods: Any physical merchandise purchased must be inspected at the time of in-person delivery. Refunds are only available for defective items within 7 days of purchase.
Space Rentals: General space rentals are subject to the rules provided at the time of booking. Note: Medical professionals or practitioners using the space for clinical purposes are required to sign a separate Professional Practitioner Agreement regarding licensure and liability.
Beverages: Nourish sells non-alcoholic beverages. In the event that alcohol is served or sold in the future, all users must comply with the Nova Scotia Liquor Control Act. Nourish reserves the right to refuse service to anyone at any time.
8. Physical House Rules & Termination
Nourish - Offline Social Club is a community built on respect. Your digital membership and physical access are contingent upon following our "House Rules."
Zero Tolerance: We have zero tolerance for sexism, homophobia, racism, harassment, or "nasty" behavior toward staff or other members.
Right to Terminate: Nourish reserves the right to immediately terminate your membership and block your access to the Site and physical location, without refund, if you violate these Terms, the Code of Conduct, or physical House Rules.
9. Limitation of Liability
While these Terms govern the use of our Site, physical participation at Nourish - Offline Social Club is subject to a separate Release of Liability and Waiver, which must be signed via Activity Messenger prior to your first visit.
10. Photography Policy
Paid Events: Nourish may contract a photographer to capture atmospheric shots focusing on materials, hands, and the ambient environment. Images are intentionally non-identifiable and will not feature guests' faces in marketing or promotional materials without permission. If you prefer not to appear in any photographs whatsoever, please notify the photographer or host privately and we will accommodate your request.
Free Events: By attending a free Nourish event, you acknowledge that photography and video may be taken and used for marketing, promotional, and social media purposes. If you have concerns, please speak to a the host before the event begins.
Guest Photography: Out of respect for all attendees, guests are asked to refrain from photographing or filming other participants without their explicit individual consent. Nourish reserves the right to ask any guest to stop photographing others if it is deemed disruptive or unwelcome.
11. Governing Law & Dispute Resolution
These Terms and Conditions are governed by the laws of the Province of Nova Scotia. In the event of a dispute, we encourage you to contact us directly to reach an amicable resolution. Any formal legal proceedings shall be handled in the courts of Halifax, Nova Scotia.
